Packaging defect
Context
A French transport company entrusts a batch of aluminium sheet to a Romanian transport company.
During this international transport under CMR, damages due to rust are generated.
The Romanian company contests its responsibility following the conclusions of its surveyor concluding to a packing defect
CRTL’s action
CRTL is instructed by the Insurers to recover the amount compensated to its Insured.
After numerous emails and phone calls (over a period of 4 months), the Romanian transport company accepts a settlement of 50% of the amount claimed.
Intrusion of migrants
Context
A French transport company is instructed to carry out a transport of food products, under controlled temperature, between France and the United Kingdom.
When the shipment was received in England, the presence of migrants was noticed in the refrigerated trailer.
The whole load is then considered as a total loss by the consignee, who proceeds to the destruction.
CRTL’s action
CRTL is instructed by the Ad Valorem Insurers to recover the amount compensated to its Insured.
After contacting and discussing with the carrier’s liability insurers, CRTL was able to recover not only the total amount of the loss of goods, but also the destruction costs and the fees of the expert appointed for the purposes of the out of court assessment.
